1. Agreement to Terms

By accessing or using the Etruscan mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years old to use Etruscan. By using the App, you represent and warrant that you meet this age requirement.

3. Account Terms

Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• One person or legal entity may not maintain more than one free account
• You may not use the App for any illegal or unauthorised purpose

Account Security

• You must immediately notify us of any unauthorised use of your account at support@etruscan.io
• We are not liable for any loss or damage from your failure to maintain account security

4. Acceptable Use

You agree NOT to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
• Generate content that contains hate speech, discrimination, or promotes violence
• Use the App to impersonate any person or entity
• Attempt to reverse engineer, decompile, or disassemble the App
• Use automated systems (bots, scripts) to access the App without our prior written permission
• Interfere with or disrupt the App or servers
• Violate any applicable laws or regulations
• Distribute malware, viruses, or harmful code through the App
• Use the App to spam, phish, or engage in fraudulent activity

Violation of these terms may result in immediate termination of your account.

5. Intellectual Property

Your Content

• You retain all ownership rights to content you create using Etruscan
• By using the App, you grant us a limited licence to process your prompts and persona data solely for the purpose of generating content for you
• You represent that you have all necessary rights to the input data you provide

Our Intellectual Property

• The App, including its design, code, features, and branding, is owned by Etruscan
• You may not copy, modify, distribute, sell, or lease any part of the App
• You may not use our trademarks, logos, or brand without prior written permission

6. Subscription Terms

Free Tier

• 50 content generations per calendar month (resets on the 1st of each month)
• Maximum 2 personas
• 3 persona edits per persona per month
• Access to all content types (Social Posts, Blog Articles, Press Releases, General Notes)

Pro Tier

Pricing:

• Monthly: £7.99 per month
• Annual: £79.99 per year (20% discount)

Trial:

• 7-day free trial for new Pro subscribers
• You may cancel during the trial period without charge
• After the trial, you will be charged the subscription fee

Features:

• 500 content generations per calendar month
• Unlimited regenerations (do not count toward limit)
• Maximum 10 personas
• Unlimited persona edits
• Access to all content types

Billing

• Subscriptions are billed in advance on a recurring basis (monthly or annually)
• Billing occurs on the date you subscribe and on the same day each subsequent period
• All fees are in British Pounds (GBP)
• Payment processing is handled securely by Stripe

Cancellation

• You may cancel your subscription at any time from the App settings
• Cancellation takes effect at the end of your current billing period
• You will retain Pro features until the end of the paid period
• No refunds for partial months or unused generations
• Upon cancellation, your account will revert to Free tier limits

Price Changes

• We may change subscription prices with 30 days' notice via email
• Price changes apply to new subscribers and renewals after the notice period
• Existing subscribers will receive the new pricing upon their next renewal

Refund Policy

• No refunds for partial subscription periods
• No refunds for unused generations
• If you believe you were charged in error, contact support@etruscan.io within 7 days

7. Usage Limits

Generation Limits

• Free tier: 50 generations per calendar month
• Pro tier: 500 generations per calendar month
• Limits reset on the 1st of each month
• If you reach your limit, you must upgrade to Pro or wait until the next month

Fair Use

• Excessive use that impacts service performance may result in temporary throttling
• We reserve the right to enforce fair use policies to protect service quality for all users

8. Service Availability

"As Is" Basis

• The App is provided "as is" and "as available" without warranties of any kind
• We do not guarantee 100% uptime or uninterrupted service
• We may suspend the service for maintenance, updates, or technical issues

Service Changes

• We reserve the right to modify, suspend, or discontinue any feature at any time
• We will provide reasonable notice for significant changes when possible

Termination

We may terminate or suspend your account if you:

• Violate these Terms
• Engage in fraudulent or abusive behaviour
• Have not used your account for an extended period (12+ months) with prior notice

9. Content Generation Disclaimer

AI-Generated Content

• Content generated by Etruscan is created using AI technology
• We do not guarantee the accuracy, completeness, or quality of generated content
• You are responsible for reviewing and editing all generated content before use
• We are not liable for any consequences resulting from your use of AI-generated content

User Responsibility

• You must ensure all generated content complies with applicable laws
• You are responsible for fact-checking and verifying information
• You must ensure you have rights to any input data (prompts, topics, persona information)

10. Limitation of Liability

To the maximum extent permitted by UK law:

• We are not liable for any indirect, incidental, special, or consequential damages
• We are not liable for lost profits, data loss, or business interruption
• Our total liability is limited to the amount you paid us in the last 12 months
• We are not liable for issues caused by third-party services (OpenAI, Stripe, Supabase)

This limitation applies even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless Etruscan from any claims, damages, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Content you generate and distribute using the App

12. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

13. Dispute Resolution

Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

Jurisdiction

Any disputes arising from these Terms or your use of the App shall be resolved in the courts of England and Wales.

Informal Resolution

Before initiating legal action, you agree to first contact us at support@etruscan.io to attempt to resolve the dispute informally.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Etruscan regarding the use of the App and supersede any prior agreements.

16. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

17. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

18. Changes to Terms

We may update these Terms from time to time. Changes will be communicated via:

• Email notification to your registered email address
• In-app notification on next login
• Updated "Effective Date" at the top of this document

Your continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the App and may delete your account.
